Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the CONCAM construction site monitoring platform (the "Service") operated by DSJ Holdings MB ("CONCAM", "we", "us", "our").

By accessing or using the Service, you and the organisation you represent ("Client", "you") agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

The Service is intended exclusively for business-to-business (B2B) use by construction companies, project managers, and their authorised representatives. The Service is not intended for consumers.

2. Description of Service

CONCAM provides:

  • A web-based client portal for viewing construction site camera feeds
  • Timeline playback of historical site imagery
  • 360° panoramic site walk functionality using uploaded panoramic imagery
  • Organisation-based access control and user management
  • Camera device management and monitoring infrastructure (where applicable)

3. Account Registration and Access

3.1 Eligibility

You must be at least 18 years old and have the authority to enter into these Terms on behalf of your organisation. By registering, you represent that you meet these requirements.

3.2 Account Security

You are responsible for maintaining the confidentiality of your credentials and for all activities conducted under your account. You must notify us immediately at info@dsj.lt if you suspect unauthorised access.

3.3 Organisation Administration

Organisation administrators are responsible for managing user access within their organisation, including inviting, suspending, and removing members.

4. Client Obligations

By using the Service, you agree to:

  • Ensure all camera hardware is installed in compliance with local regulations, including planning permissions and building regulations where required.
  • Display appropriate notices on construction sites where cameras capture images of individuals, in compliance with GDPR and national data protection laws.
  • Ensure that individuals whose images may be captured by site cameras have been duly informed, where required by law.
  • Not upload any content that is unlawful, harmful, or infringes the rights of any third party.
  • Not attempt to circumvent, disable, or interfere with any security features of the platform.
  • Not reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Comply with all applicable laws and regulations in connection with your use of the Service.

5. Our Obligations

CONCAM agrees to:

  • Provide the Service with reasonable skill and care.
  • Implement appropriate security measures to protect your data as described in our Privacy Policy.
  • Notify you of any material changes to the Service or these Terms with at least 30 days' advance notice.
  • Maintain reasonable availability of the platform, subject to scheduled maintenance and circumstances beyond our control.

6. Data Processing

To the extent that CONCAM processes personal data on your behalf (e.g., images of your site employees), CONCAM acts as a data processor and you act as the data controller for such data. Processing is governed by our Data Processing Agreement (available on request) and our Privacy Policy.

For data relating to your account and platform usage, CONCAM acts as the data controller.

7. Intellectual Property

All intellectual property rights in the Service, including software, designs, trademarks, and content created by CONCAM, remain the exclusive property of DSJ Holdings MB. Nothing in these Terms transfers any intellectual property rights to you.

You retain ownership of all imagery and data you upload to the platform. By uploading content, you grant CONCAM a limited licence to store, process, and display that content solely for the purpose of providing the Service.

8. Fees and Payment

Fees for the Service are agreed separately in a written service agreement or order form between CONCAM and the Client. In the absence of such an agreement, use of the Service is subject to prior written authorisation from CONCAM. All fees are exclusive of applicable VAT unless stated otherwise.

9. Limitation of Liability

To the fullest extent permitted by applicable law, CONCAM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption.

CONCAM's total aggregate liability to you in connection with the Service shall not exceed the total fees paid by you to CONCAM in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes liability for fraud, gross negligence, personal injury, or any other liability that cannot be excluded by applicable law.

10. Service Availability and Disclaimers

The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for image loss caused by camera hardware failures, network outages, power interruptions, or circumstances beyond our reasonable control (force majeure).

11. Termination

Either party may terminate access to the Service by providing written notice. Upon termination, your access will be revoked and your data retained as described in our Privacy Policy, after which it will be deleted. CONCAM reserves the right to suspend or terminate access immediately in the event of a material breach of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Lithuania. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved amicably. If not resolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Republic of Lithuania.

Clients based in other EU/EEA member states retain the right to bring proceedings in their country of domicile under applicable consumer or business protection laws.

13. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated with at least 30 days' notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
